Terms of Service for Ready Button

These Terms of Service ("Terms") are a legally binding agreement between you ("User") and McVay Industries, LLC, a Texas limited liability company ("Company", "we", "us"), doing business as Ready Button. These Terms govern your access to and use of the readybtn.com website and the Ready Button application (collectively, the "Service").

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity.

2. The Service & No Emergency Use

The Service provides automated notifications and alerts.

CRITICAL WARNING:

  • NOT FOR EMERGENCIES: Ready Button is a convenience notification tool. It is NOT a life-safety device or a replacement for emergency services (e.g., 911).
  • NO GUARANTEE OF DELIVERY: Notification delivery depends on third-party networks (Internet, SMS carriers, etc.). We do not guarantee that any alert will be delivered or that it will be delivered in a timely manner.

3. User Responsibilities & Data

  • Accuracy: You are responsible for ensuring that all contact information (phone numbers, emails) provided for alerts is accurate and that you have permission to send notifications to those destinations.
  • Account Security: You are responsible for maintaining the confidentiality of your login credentials.
  • Compliance: You agree to use the Service only for lawful purposes and in compliance with all applicable laws, including the Texas Data Privacy and Security Act (TDPSA).

4. Fees and Payment

If the Service requires a subscription or fee:

  • Payments are processed through our third-party provider, Stripe.
  • All fees are non-refundable unless otherwise required by law.
  • We reserve the right to change our pricing upon thirty (30) days' notice.

5. Limitation of Liability (Texas Specific)

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MCVAY INDUSTRIES, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

Specifically, the Company is not liable for:

  • Any failure or delay in the delivery of a notification.
  • Any damage to property or person resulting from a missed or delayed alert.
  • Any unauthorized access to your data not caused by our gross negligence.

6. Indemnification

You agree to defend, indemnify, and hold harmless McVay Industries, LLC from and against any claims, damages, or expenses (including attorney's fees) arising from your use of the Service or your violation of these Terms.

7. Intellectual Property

All software, branding, and content related to Ready Button and McVay Industries, LLC are the exclusive property of the Company. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

8. Governing Law & Venue

These Terms are governed by the laws of the State of Texas. Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Williamson County, Texas.

9. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via the Service or the email address associated with your account. Your continued use of the Service after changes are posted constitutes acceptance.
